Affirmative Litigation at BU School of Law

Twenty-four legal aid attorneys from across the country recently participated in CLAE's combined in person and online Affirmative Litigation Training. During several weeks of online activities, participants learned the fundamentals of the justiciability of typical legal services affirmative claims under 42 U.S.C. §1983, while wrestling with these concepts in the context of a familiar legal services case study involving access to shelter and potential discrimination on the basis of race and disability. After drafting a federal affirmative complaint (the culminating exercise of the online portion), participants came together at Boston University School of Law for four days on site during which they argued for and against emergency relief for our case study client, considered and experimented with discovery strategies to establish essential facts in the case, wrestled with the necessary elements for a successful consent decree in the event the case was settled, and argued for and against a motion to dismiss their complaints for failure to state a claim.
